This unit involves the nature and type of proprietary interests in chattels and land, and their creation and relative enforceability at law and in equity. This unit covers the Priestly 11 requirements in respect to property law.
Topics examined in this unit include:
- Meaning and purposes of the concept of property.
- Possession, seisin and title.
- Nature and type (i.e. fragmentation) of proprietary interests.
- Creation and enforceability of proprietary interests.
- Legal and equitable remedies.
- Statutory schemes of registration.
- Acquisition and disposal of proprietary interests.
- Concurrent ownership.
- Proprietary interests in land owned by another.
- Mortgages.
This unit will include a comparative transnational and/or international element, where appropriate.
